Terms of Use

1. Definitions

AgriTecta means the AgriTecta agricultural market intelligence service, operated by K. Rozite, including its affiliates and successors.

Platform means the AgriTecta website, analytics dashboard, APIs, and all related services, including weather data, yield forecasts, crop condition reports, news tracking, and predictive models.

Content includes all data, text, graphics, maps, visualizations, software, models, analyses, reports, and other materials made available through the Platform.

2. License

Subject to these Terms, AgriTecta grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform solely for your own internal business, research, educational, or informational purposes.

No ownership rights are transferred.

3. Intellectual Property

Except where expressly stated otherwise, all intellectual property rights in the Platform are owned by K. Rozite (operating as AgriTecta) or its licensors. This includes software, APIs, dashboard design, user interface, visualizations, data models, methodologies, derived datasets, forecasts, documentation, trademarks, logos, and branding.

Nothing in these Terms transfers ownership of any intellectual property rights to the user.

4. Open Data and Third-Party Data

The Platform may incorporate publicly available, open-source, or licensed third-party datasets (including but not limited to USDA reports, satellite imagery, and weather station data). Ownership of such datasets remains with their respective owners.

Where required, users must comply with the original licenses applicable to those datasets.

AgriTecta claims ownership only over its own data harmonization, quality assurance, integration, derived datasets, analytics, models, indices, visualizations, software, documentation, and methodologies.

5. Permitted Use

You may:

• – browse the Platform;
• – analyze available information;
• – generate reports;
• – download data where expressly permitted;
• – use Platform outputs internally;
• – cite Platform results in publications, subject to Section 9.

6. Prohibited Uses

Unless expressly authorized in writing, you shall not:

• – resell any data obtained from the Platform;
• – sublicense Platform Content;
• – redistribute datasets;
• – commercially exploit Platform Content;
• – create a competing database using Platform data;
• – systematically copy or extract Platform data;
• – scrape the Platform;
• – use bots or automated harvesting tools;
• – circumvent security measures;
• – share login credentials;
• – remove copyright notices;
• – modify proprietary software;
• – reverse engineer, decompile, or disassemble the Platform;
• – reverse engineer proprietary algorithms, models, methodologies, or data processing techniques;
• – copy, imitate, reproduce, or create derivative works of the Platform's user interface, visual design, dashboards, layouts, navigation, workflows, or overall look and feel;
• – use Platform Content to develop, benchmark, validate, or improve competing products or services;
• – use Platform Content to train, fine-tune, benchmark, or evaluate artificial intelligence or machine learning systems without AgriTecta's prior written consent.

7. Database Rights

AgriTecta asserts all applicable rights under Directive 96/9/EC on the legal protection of databases and any implementing national legislation.

Users may not extract or reutilize all or a substantial part of the contents of the Platform's databases without prior written permission.

Repeated or systematic extraction of insubstantial parts of the database is likewise prohibited where such extraction conflicts with the normal exploitation of the database or unreasonably prejudices AgriTecta's legitimate interests.

8. Commercial Restrictions

The Platform may not be used:

• – to develop competing commercial products;
• – as the basis for commercial redistribution;
• – to provide data services to third parties;
• – for white-label products;
• – as part of another analytics platform;
• – for resale in any form.

9. Attribution

Any public presentation, publication, report, article, academic work, or media publication using information obtained from the Platform shall include attribution substantially in the following form:

Where third-party licensing requires additional attribution, users remain responsible for complying with those requirements.

10. User Accounts

Users are responsible for:

• – maintaining account security;
• – safeguarding passwords;
• – all activities performed under their account.

AgriTecta may suspend or terminate accounts suspected of unauthorized use or violation of these Terms.

11. Subscriptions, Billing and Free Trial

AgriTecta offers subscription-based access to the Platform. Current plans and pricing are published on the Platform.

Free Trial. New users may be eligible for a 30-day free trial providing full access to the subscribed plan's features. At the end of the trial period, your subscription will automatically convert to a paid subscription at the applicable rate (currently €99 per month for the Essential plan) unless you cancel before the trial ends.

Recurring Billing. Subscriptions are billed monthly in advance. By subscribing, you authorize AgriTecta to charge the applicable fee each billing cycle until you cancel.

Payment Processing. Payments are processed through a third-party payment provider. AgriTecta does not store your payment card details. Your use of the payment provider's services is subject to their own terms and conditions.

Price Changes. AgriTecta may change subscription pricing at any time. You will be notified of any price change at least 30 days before it takes effect. Continued use of the Platform after a price change constitutes acceptance of the new pricing.

12. Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current paid billing month. You will retain access to the Platform until your current billing period expires.

No refunds are issued for partial billing periods. If you cancel during your free trial, you will not be charged.

13. APIs

Where APIs are provided:

• – API keys remain confidential;
• – rate limits may apply;
• – automated requests may be restricted;
• – AgriTecta may revoke API access at any time.

API access does not grant ownership of any data.

14. Availability

AgriTecta may modify, suspend, discontinue, or update any part of the Platform at any time.

No guarantee is made regarding uninterrupted availability.

15. Accuracy and Data Quality

Although AgriTecta uses reasonable efforts to provide accurate and up-to-date information — including weather data, yield forecasts, crop condition reports, and predictive models — the Platform is provided for informational purposes only.

AgriTecta does not guarantee the completeness, accuracy, timeliness, or suitability of any Content for any particular purpose. Data may be delayed, incomplete, or subject to revision.

Users remain solely responsible for verifying information and for all decisions made using Platform outputs.

16. No Financial or Investment Advice

Nothing on the Platform constitutes financial, investment, trading, or other professional advice. AgriTecta is not a licensed financial advisor, broker, or dealer.

Platform Content — including forecasts, models, analytics, and market intelligence — is provided strictly for informational purposes. You should not rely on Platform Content as the sole basis for any trading, hedging, investment, or financial decision.

You bear full responsibility for your own trading and investment decisions. AgriTecta accepts no liability for any losses arising from decisions made in reliance on Platform Content.

17. Disclaimer

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGRITECTA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

18. Limitation of Liability

To the fullest extent permitted by law, AgriTecta shall not be liable for:

• – indirect damages;
• – consequential damages;
• – lost profits;
• – business interruption;
• – loss of goodwill;
• – loss of data;
• – economic loss arising from use of the Platform.

AgriTecta's total aggregate liability arising out of these Terms shall not exceed the fees paid by the user during the preceding twelve months.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

19. Privacy

Personal data are processed in accordance with AgriTecta's Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR).

20. Confidentiality

Users shall not disclose non-public information obtained through the Platform — including pre-release data, unreleased forecasts, beta features, or internal methodologies — where such information is designated confidential or would reasonably be understood to be confidential.

This obligation survives termination of your account.

21. Suspension and Termination

AgriTecta may suspend or terminate access immediately where:

• – these Terms are violated;
• – unlawful activity is suspected;
• – Platform security is compromised.

Termination does not affect accrued legal rights or obligations that by their nature survive termination, including Sections 3, 7, 16, 17, 18, and 20.

22. Export Controls

Users shall comply with all applicable export control, sanctions, and trade laws when accessing or using the Platform.

23. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands.

Any dispute arising from or relating to these Terms shall be submitted exclusively to the competent courts of the Netherlands, unless mandatory law provides otherwise.

24. Changes to These Terms

AgriTecta may amend these Terms at any time.

Updated Terms become effective upon publication on the Platform. Where material changes are made, AgriTecta will use reasonable efforts to notify users in advance.

Continued use of the Platform constitutes acceptance of the revised Terms.
